OhMessage

Terms of sale

Last updated: 7 November 2026

1. Purpose

These terms of sale govern the sale of personalised videos by OhMessage (Xavier Vignon, sole proprietor, SIRET 514 390 881 400 41) through the website ohmessage.com. Any order implies full acceptance of these terms. They are governed by French law; the French version prevails.

2. Product and price

OhMessage offers a personalised video in which a character, chosen by the customer among those offered on the website, says with their own voice a message written from the information provided by the customer (recipient, occasion, anecdote). Depending on the character, a visual personalisation is added to the image (for example, the recipient's name embroidered on Santa Claus's hat).

Offer: one video of about 30 seconds at the price of €9.90 including taxes. VAT not applicable, article 293 B of the French General Tax Code (micro-enterprise regime).

Nothing is generated before payment. The customer therefore does not see a preview of the final video before paying; the image and the demo video shown on the website are indicative.

3. Ordering

Ordering takes place in several steps on the website: choice of character, information about the recipient, the occasion and an optional anecdote, review of the message, the customer's email address, then secure payment integrated into the website (Stripe technology, with no redirection to a third-party site).

The message is suggested to the customer by an artificial intelligence tool from their answers. The customer can read it and freely edit it before approving it; they are solely responsible for it. The text is frozen at the time of payment.

Payment is subject to the express acceptance of these terms and of the privacy policy. The order is final once payment is validated.

4. Content checks

The message is automatically checked before payment. A message that does not comply with the rules of use in article 5 is refused and no payment is taken.

Some messages may be held for a manual check before any production. If, after review, a paid message is refused, the order is fully refunded.

5. Prohibited uses

It is forbidden to use OhMessage to create content constituting harassment, threats, hateful or discriminatory statements, sexual content, scams, impersonation of a real person or of an authority, or more generally any unlawful content.

OhMessage reserves the right to refuse any order contrary to these rules.

6. Delivery

The video is made available on a private web page whose link is sent by email. It can be watched, downloaded and shared there. It is usually available within minutes of payment; this can take several tens of minutes under heavy load. In all cases, delivery takes place within a maximum of 48 hours.

The link is valid for 90 days. After that, the video is deleted: remember to download it.

7. Right of withdrawal

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. As the OhMessage video is personalised from the information and the message provided by the customer, the order cannot be withdrawn once production has started. Production starts immediately after payment is validated.

8. Satisfaction guarantee

If the result does not match the order (for example an error in a name or in the message attributable to OhMessage, or a defective video), a corrected version is produced and sent free of charge; failing that, the order is refunded. To make a request: contact@ohmessage.com.

As images, voices and videos are generated by artificial intelligence, slight variations in appearance or pronunciation are inherent to the process and are not a defect. This guarantee does not cover input or approval errors made by the customer.

9. Payment

Payment is made online by bank card or by the payment methods offered on the website, through the secure platform Stripe. OhMessage does not store any banking data.

10. Liability

The character used in the videos is generated by artificial intelligence; it does not represent any real person. The customer is responsible for the content of the message they approve. OhMessage cannot be held liable for any misuse of the video by the customer after delivery.

11. Complaints and mediation

For any complaint, the customer can contact contact@ohmessage.com. In accordance with article L616-1 of the French Consumer Code, in the event of a dispute not resolved amicably, the consumer has the right to use a consumer mediation service free of charge.

12. Governing law

These terms are governed by French law. In the event of a dispute and failing an amicable resolution, the French courts alone have jurisdiction.
